These Terms of Service (“Terms”) govern your use of the STIMS website and any purchases made through our online store (the “Site”). The Site is operated by STIMS Energy LLC (“STIMS,” “we,” “us,” or “our”). By accessing the Site or placing an order, you agree to be bound by these Terms.

1) Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase from the Site.

2) Products and Use

STIMS products are consumable goods. You are responsible for using products as directed on the label.

Health and safety notice: If you are pregnant or nursing, have a medical condition, are sensitive to caffeine or stimulants, or take medications, consult a healthcare professional before use. Do not exceed recommended use. Keep out of reach of children.

Statements on this Site have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease.

3) Ordering, Pricing, and Payment

All prices are listed in USD unless otherwise stated. Prices, promotions, and product availability may change without notice.

We may refuse, cancel, or limit any order at our discretion, including suspected fraud, resale activity, or violation of these Terms. If we cancel an order after payment is captured, we will issue an appropriate reversal or credit.

You agree to provide current, complete, and accurate purchase and account information.

4) Shipping, Delivery, and Risk of Loss

Shipping timelines are estimates and not guaranteed. Title and risk of loss pass to you upon delivery to the carrier, to the extent permitted by law.

If a package is marked delivered but you cannot locate it, please contact the carrier first and then contact us at support@stims.co so we can assist.

5) Changes or Cancellations

Orders begin processing quickly. If you need to cancel or change an order, email support@stims.co immediately with your order number.

• If an order has not yet been processed or shipped, we may be able to cancel or modify it.

• If an order has already been processed or shipped, it may not be cancelable.

6) Returns, Replacements, and Store Credit (No Cash Refunds)

Because our products are consumable, we do not accept returns for safety and quality reasons.

We offer a Satisfaction Guarantee for eligible orders: if you are not satisfied, contact us within 30 days of delivery. We will provide, at our discretion, either:

• a replacement, or

• store credit.

No cash refunds.

We may request your order number and photos of the product/packaging. We limit satisfaction claims to one per customer/household.

For damaged, defective, or incorrect items, contact us within 7 days of delivery with photos of the product and shipping packaging. We’ll provide a replacement or store credit.

7) Subscriptions

If you purchase a subscription, you authorize recurring charges to your chosen payment method at the frequency shown at checkout until canceled.

You can cancel or modify a subscription through your customer account (if available) or by emailing support@stims.co.

Changes or cancellations must be submitted at least 48 hours before the next scheduled renewal to apply to that renewal. Orders already processed for renewal may not be canceled.

8) Promotions and Discount Codes

Discount codes:

• have no cash value,

• may not be combined unless stated,

• may be limited to one per customer,

• may be modified or discontinued at any time.

9) Intellectual Property

All content on the Site—including product names, logos, trademarks, text, images, graphics, and design—is owned by or licensed to STIMS and is protected by intellectual property laws. You may not use our content without written permission.

10) User Content and Reviews

If you submit reviews, comments, photos, or other content, you grant STIMS a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and display that content for marketing and other business purposes. You represent that your content is accurate and does not infringe third-party rights.

11) Prohibited Uses

You agree not to:

• violate any laws or regulations,

• infringe intellectual property rights,

• submit false or misleading information,

• attempt to interfere with the Site’s security or operation,

• use the Site for unauthorized resale or distribution of our products.

12) Disclaimer of Warranties

To the fullest extent permitted by law, the Site and products are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13) Limitation of Liability

To the fullest extent permitted by law, STIMS will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of or related to your use of the Site or purchase/use of products.

In any event, STIMS’ total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim.

14) Indemnification

You agree to indemnify and hold harmless STIMS and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including attorneys’ fees) arising from your breach of these Terms or misuse of the Site or products.

15) Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes will be brought in the state or federal courts located in Collier County / Naples, Florida, unless otherwise required by law.

16) Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above reflects the latest revision. Your continued use of the Site after changes means you accept the updated Terms.
